Welcome to High Desert Responder Gear. By accessing, browsing, or purchasing from hdrgear.com, you agree to these Terms of Service.

We know nobody wakes up excited to read Terms of Service. Unfortunately, putting “just be reasonable” in this box apparently does not cover everything, so here we are.

Please read the following terms before using the site or placing an order.

1. General

These Terms of Service apply to users of hdrgear.com, including visitors and customers.

By using this website, you agree to comply with these terms and all applicable laws and regulations.

We may update these terms from time to time as HDRG grows, laws change, or somebody discovers a situation we did not think needed a rule until it happened.

The most current version will always be posted on this page.

2. Products & Product Information

High Desert Responder Gear offers equipment, apparel, patches, accessories, and other products intended primarily for law enforcement, fire, EMS, public safety, veterans, responders, and related customers.

We make reasonable efforts to ensure product descriptions, photographs, specifications, availability, and pricing are accurate.

That said, mistakes happen.

Colors may appear slightly different depending on your screen, manufacturers may update products, and occasionally a decimal point ends up somewhere it absolutely should not be.

We reserve the right to correct errors, update product information, change pricing, or discontinue products without prior notice.

If an obvious pricing or listing error affects an order, we may cancel the affected order and issue a refund.

3. Orders & Payment

By placing an order, you represent that the information you provide is accurate and that you are authorized to use the payment method submitted.

Orders are subject to acceptance and product availability.

We reserve the right to refuse or cancel an order when reasonably necessary, including suspected fraud, payment problems, inventory errors, pricing errors, legal restrictions, or other circumstances that prevent us from completing the order.

If we cancel an order after payment has been processed, the applicable amount will be refunded.

No, ordering 400 units because somebody accidentally listed them for fourteen cents each does not automatically make you the greatest negotiator in American history.

4. Legal Use of Products

Customers are responsible for complying with all federal, state, and local laws applicable to products they purchase or possess.

Some products may be restricted in certain jurisdictions or may be intended only for authorized professional use.

It is the customer's responsibility to determine whether possession, purchase, use, or transportation of a product is lawful in their location.

High Desert Responder Gear does not authorize or encourage the unlawful use of any product sold through our store.

5. Shipping & Delivery

Shipping estimates are exactly that: estimates.

We will make reasonable efforts to process and ship orders promptly, but delivery may be affected by carriers, weather, holidays, supply issues, natural disasters, or other circumstances outside our control.

Once an order ships, tracking information will be provided when available.

We cannot personally chase the delivery truck down the highway, although there are days when it is tempting.

6. Returns & Refunds

Returns, exchanges, and refunds are governed by our Returns & Exchanges Policy.

Items must meet the requirements stated in that policy to qualify for return or exchange.

We reserve the right to refuse returns that do not meet those requirements, including merchandise that has been used, damaged, altered, washed, or otherwise returned in a condition that prevents resale.

Our philosophy is simple: treat us fairly and we will treat you fairly.

7. Intellectual Property

Unless otherwise stated, HDRG branding, logos, original graphics, photographs, written content, page designs, and other original materials appearing on this website are owned by or licensed to High Desert Responder Gear.

They may not be copied, reproduced, republished, distributed, or used commercially without permission.

Manufacturer names, trademarks, logos, and product images remain the property of their respective owners where applicable.

You are welcome to admire our stuff. Please do not steal it.

8. Website Use

You may not use this website to:

Violate any applicable law
Attempt to gain unauthorized access to the website or associated systems
Introduce malicious software or code
Commit or attempt fraud
Scrape or reproduce site content for unauthorized commercial purposes
Interfere with the operation or security of the website

Basically, shop, browse, ask questions, and enjoy yourself. Do not make our IT problems more exciting than they already need to be.

9. Third Party Services

Those services may be governed by their own terms and privacy policies.

Nothing on this website should be interpreted as professional, legal, medical, tactical, or safety advice.

Customers are responsible for using products appropriately and in accordance with manufacturer instructions, training, agency policies, and applicable law.

If a manufacturer says not to use something as a hammer, please resist the urge to prove them wrong.

11. Limitation of Liability

To the fullest extent permitted by applicable law, High Desert Responder Gear will not be liable for indirect, incidental, special, or consequential damages resulting from use of this website or products purchased through it.

Where permitted by law, our liability relating to a particular purchase will not exceed the amount paid for the applicable product or order.

Nothing in these terms is intended to waive or limit any consumer rights that cannot legally be waived.

These Terms of Service are governed by the laws of the State of New Mexico, without regard to conflict of law principles.

Any dispute arising from these terms or use of the website will be handled in accordance with applicable New Mexico and federal law.

13. Severability

If any portion of these terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

In normal language: one bad paragraph does not get to take the rest of the document down with it.
